(Feb. 5, 2010 - 1:30 p.m.) Attorney Drew Bracken announced today that Linda Beyea filed a response late Friday morning to the school district's letter of consideration of termination.
The case will now be reviewed by an administrative law judge.
"That's really the only part of this that will be public," said Bracken, the attorney representing the school board.
Bracken said Thursday that the hearing would likely be held in Ames, though the proceeding, and all records of it, will not be made available to the public.
Such a hearing must take place in the next 30 days. The two sides will now meet to chose the administrative law judge that will hear the case.
Beyea was placed on administrative leave Monday during a school board meeting and presented with a letter detailing 25 reasons why the board took that action. The letter claimed Beyea had not furnished the board with adequate information, failed to be an educational leader, and did not adequately communicate with district personnel or the public. The letter also states that the termination would be for cause, and as such the district would not have to buyout the remainder of Beyea's contract, which runs through June 30, 2011.
Deputy superintendent Tim Taylor is currently interim superintendent.
The case could move on to district court if the losing side in the administrative law hearing choses to appeal.
